AGENCY, § 50sufficiency of evidence as to agency. In a suit to foreclose a mortgage wherein it was contended by the record owner that the contract purchasers had made payments to an agent for the plaintiff note holder in excess of the amount due on the note, the evidence did not show that the recipient of the moneys was the agent of the plaintiff.

Appeal from Circuit Court of Winnebago county; Hon. WILLIAM L. PIERCE, presiding.

Affirmed. Heard in this court at February term, 1942.
