Opinion

CASE NO.: 3D18-2066

02-05-2019

PEOPLE'S TRUST INSURANCE COMPANY, Appellant(s)/Petitioner(s), v. Michael ABREU and Jessica Abreu, Appellee(s)/Respondent(s)

We grant appellees' motion to dismiss the appeal, as the order sought to be appealed does not, on its face, "determine...the entitlement of a party...to appraisal" as is required under Rule 9.130(a)(3)(C)(iv). See, e.g., Citizens Property Insurance Corporation vs. Calonge, 246 So. 3d 447 (Fla. 3d DCA 2018).

Upon consideration of appellees' motion for entitlement to attorney's fees, it is ordered that said motion is conditionally granted and remanded to the trial court to fix amount, contingent upon appellees ultimately prevailing in this case.

FERNANDEZ, LOGUE and SCALES, JJ., concur.
