ORDER TO SHOW CAUSE

Motion by appellant to enlarge the time to perfect an appeal from a judgment of conviction of the Justice Court of the Village of Lynbrook, Nassau County, rendered September 25, 2018. By decision and order to show cause dated August 2, 2019, the motion was held in abeyance and the matter was remitted to the Justice Court for a hearing to determine if the transcript of the trial proceedings held on September 25, 2018 could be reconstructed. This court has been advised that appellant failed to appear on three scheduled dates for the reconstruction hearing.

Now, on the court's own motion, it is

ORDERED that the parties show cause before this court why the appeal should or should not be dismissed on the ground that appellant has abandoned the appeal, by filing an affidavit or affirmation on that issue with the Clerk of this court on or before November 22, 2019; and it is further,

ORDERED that the Clerk of this court, or his designee, is directed to serve a copy of this order to show cause on the parties or their attorneys by regular mail.
