THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. JAMES ARTHUR ZEITZ, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, FAHEY, AND PERADOTTO, JJ.

Defendant having moved for a writ of error coram nobis seeking leave to file a late notice of appeal from a judgment of Niagara County Court, rendered March 19, 2004,

Now, upon reading and filing the affidavit of James Zeitz sworn to December 14, 2013, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that James Arthur Zeitz is hereby directed to serve the notice of appeal dated March 29, 2004 in accordance with CPL 460.10 on or before April 3, 2014 (see People v Syville, 15 NY3d 391 [2010]).
