Mar 7, 2005
16 A.D.3d 441 (N.Y. App. Div. 2005)

Opinion

2003-01905.

March 7, 2005.

Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Smith, J.), rendered January 28, 2003, convicting him of robbery in the first degree (two counts) and kidnapping in the second degree, upon his plea of guilty, and imposing sentence.

Before: H. Miller, J.P., S. Miller, Goldstein, Mastro and Lifson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
