ORDER

Michelle M. Rick Presiding Judge.

The motion to waive fees is GRANTED for this case only.

Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal, the Court REMANDS this matter to the trial court for reconsideration of whether to provide defendant a copy of the requested materials after an evidentiary hearing and decision whether defendant has demonstrated good cause to provide him with another copy of the requested materials, as permitted by MCR 6.433(B) and (C). On remand, the trial court shall expressly address whether defendant asked his former appellate counsel for copies of the requested materials and whether the former counsel failed to respond or provide those items.

We do not retain jurisdiction.

Gadola, J., would DENY the delayed application for leave to appeal.
