Appellant having moved to vacate the dismissal of the appeal taken from an order of the Oneida County Court, entered August 5, 2010,

Now, upon reading and filing the affidavit of Richard Yearby sworn to July 1, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, on the condition that the appeal is perfected on or before October 31, 2011.
