66 Cal.App.4th 614b THE PEOPLE, Plaintiff and Respondent, v. BILLY WAYNE YARBOROUGH, Defendant and Appellant. F027578. California Court of Appeal, Fifth District September 1, 1998

OPINION

VARTABEDIAN, J.

It is ordered that the opinion filed herein on August 7, 1998 (65 Cal.App.4th 1417), be modified in the following particulars:

1. On page 4 of the typewritten opinion, the first sentence of the second paragraph is deleted [65 Cal.App.4th 1420, advance report, last par., lines 1-2] and the following substituted:

Here, in contrast to Edwards, the underlying felony offense is for an omission of required conduct by a convicted sex offender.

2. On page 4 of the typewritten opinion, the third sentence of the second paragraph is deleted [65 Cal.App.4th 1420, advance report, last par., lines 4-5 and p. 1421, line 1] and the following substituted:

Yarborough's failure to register as a sex offender in violation of section 290, former subdivision (g)(3) is inherently criminal, unlike the mere possession of a firearm.

This modification does not effect a change in the judgment.

Respondent's petition for rehearing is denied.

Ardaiz, P. J., and Wiseman, J., concurred.
