ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

Wiseman, J.

THE COURT:

The petition for rehearing filed in the above-entitled matter is denied.

On the court’s own motion and for good cause shown, this court’s opinion filed on February 19, 2008, is modified as follows:

On page 10, in the first paragraph, the second sentence is to read as follows: “Yann claims that allowing Villalvazo to testify about the hearsay evidence that served as the foundation for his expert opinions violated Yann’s Sixth Amendment right to confront and cross-examine witnesses as defined by the United States Supreme Court in Crawford v. Washington (2004) 541 U.S. 36 (Crawford).”

On page 14, in the last paragraph, first and fourth sentences, and page 16, first paragraph, second sentence, the references to CALCRIM No. 335 are changed to CALCRIM No. 334.

The modification does not change the judgment.
