Appellate Division of the Supreme Court of New York, Second Department
Mar 21, 2006
27 A.D.3d 674 (N.Y. App. Div. 2006)

Opinion

2004-09209.

March 21, 2006.

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Blumenfeld, J.), rendered October 13, 2004, convicting him of criminal possession of a controlled substance in the fifth degree, upon his plea of guilty, and imposing sentence.

Lynn W.L. Fahey, New York, N.Y. (Erica Horwitz of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano and Michael Tarbutton of counsel; Annmarie Giblin on the brief), for respondent.

Before: Florio, J.P., Santucci, Mastro, Rivera and Covello, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
