People v. Wyatt

Supreme Court of Michigan
Jun 17, 2004

Opinion

No. 125425.

June 17, 2004.

SC: 125425, COA: 242366, Wayne CC: 01-010733.

On order of the Court, the application for leave to appeal the November 25, 2003 judgment of the Court of Appeals is considered, and, pursuant to MCR 7.302(G)(1), in lieu of granting leave to appeal, we REMAND this case to the Wayne Circuit Court for resentencing. Defendant's sentences for carrying a concealed weapon, MCL 750.227, and possession of a firearm during the commission of a felony, MCL 750.227b, should have been imposed to run concurrently. People v. McGrady, 213 Mich. App.. 474, 486 (1995). In all other respects, leave to appeal is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.
