PEOPLE v. WRIGHT (Brian).

Prior report: Cal.App., 139 Cal.Rptr.3d 508

Petition for review granted.

The petition for review is granted.

In addition to addressing the issues raised in the petition, the parties will address (1) whether the trial court erred by refusing to grant the defense's peremptory challenge to Juror No. 4748 after acknowledging that defense counsel had provided a legitimate gender-neutral reason for challenging that particular female Caucasian juror, and (2) whether, if the trial court erred in reseating the challenged prospective juror (Juror No. 4748), the error was reversible per se or subject to a harmless error analysis.

CANTIL–SAKAUYE, C.J., KENNARD, BAXTER, WERDEGAR, CHIN, CORRIGAN, and LIU, JJ., concur.
