ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING

THE COURT:

The majority opinion in this case, filed on December 16, 2021, and appearing at 12 Cal.5th 419, is modified as follows:

1. On page 436, in the first sentence of the first full paragraph, the phrase “abused its discretion” is replaced with “erred, ” so that the sentence begins: We first analyze whether the trial court erred . . . .

2. On page 439, in the first sentence of the first full paragraph, the phrase “abuse its discretion” is replaced with “err, ” so that the sentence begins: Under the totality of circumstances described in Lynch, the trial court did not err . .

This modification does not affect the judgment.

The petition for rehearing is denied.
