ORDER

On order of the Court, the motion for immediate consideration is GRANTED. The application for leave to appeal the July 19, 2021 order of the Court of Appeals is considered. We DIRECT the Kent County Prosecuting Attorney to answer the application for leave to appeal within 28 days after the date of this order, specifically addressing whether the prosecutor's statutory right to withhold consent to a bench trial, see MCL 763.3(1), may override the defendant's constitutional right to a speedy trial, see U.S. Const, Am VI; Const 1963, art 1, § 20.

The application for leave to appeal remains pending.
