People v. Woody

Appellate Division of the Supreme Court of New York, Second Department
Apr 20, 2000
271 A.D.2d 625 (N.Y. App. Div. 2000)

Opinion

Submitted March 6, 2000.

April 20, 2000.

Appeal by the defendant from a judgment of the Supreme Court, Kings County (Gerges, J.), rendered December 22, 1997, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence.

Steven A. Feldman, Roslyn, N.Y., for appellant.

Charles J. Hynes, District Attorney, Brooklyn, N.Y. (Leonard Joblove, Florence M. Sullivan, and Mark Daniel of counsel), for respondent.

GUY JAMES MANGANO, P.J., LAWRENCE J. BRACKEN, LEO F. McGINITY, DANIEL F. LUCIANO, JJ.

DECISION ORDER

ORDERED that the judgment is affirmed.

The defendant contends that remarks made in the course of the prosecutor's summation improperly attacked his credibility. However, in light of the nature of the statements made by both attorneys in their summations, the remarks of the prosecutor were reasonable (see, People v. Estrella, 156 A.D.2d 710 ; People v. Draskin, 145 A.D.2d 500, 501 ).

The sentence was neither harsh nor excessive (see, People v. Suitte, 90 A.D.2d 80 ).
