PRESENT:

Defendant having moved pursuant to Judiciary Law §509 directing the disclosure of all records pursuant to Judiciary Law §528 and pertaining to the jury selection process in Herkimer County for grand and petit juries from 2005 to the present, and for other relief,

Now, upon reading and filing the statement of Brian R. Woody, Sr. dated January 26, 30, 2017, and the affidavit of Brian R. Woody, Sr. sworn to February 14, 2017, the notice of motion with proof of service thereof, the affidavit of Shawn Kerby, Esq. sworn to February 3, 2017, the affirmation of Robert R. Calli, Jr., Esq. dated February 15, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as moot.
