Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Oswego County Court, rendered September 21, 2016,

Now, upon reading and filing the affidavit of Martin L. Woodward sworn to June 7, 2017, the notice of motion with proof of service thereof, the affirmation of Joseph D. Pagano, Esq. dated July 6, 2017, the statement of Allison M. O'Neal, Esq. dated July 5, 2017, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal filed at the Oswego County Clerk's Office on October 24, 2016 and served on the Oswego County District Attorney on November 2, 2016 is hereby deemed timely filed and served.
