Jerome H. Woods appeals from the judgment following his entry of a nolo contendere plea to two counts of keeping a dog for the purpose of dog fighting (counts 1 & 2) and two counts of animal cruelty (counts 16 & 18). (Pen. Code, §§ 597.5, subd. (a)(1), 597, subd. (b).) Pursuant to the parties plea agreement, the court dismissed 14 similar counts and sentenced appellant to serve five years in prison, including a three-year upper term for count 1; and a consecutive eight-month term for for each of counts 2, 16 and 18. The court also ordered appellant to pay restitution, court fees, and parole revocation and restitution fines. We affirm.
On January 16, 2008, there were 11 dogs at appellants residence, including many that were emaciated, scarred, and/or injured. Appellants residence contained many objects used in dog fighting, including slat mills, a treadmill, "break sticks," and items used to build a dog fighting pit (a carpet remnant and blood-stained pieces of plywood).
We appointed counsel to represent appellant on appeal. After examining the record, counsel filed an opening brief in this court raising no issues and requested that we independently examine the record pursuant to People v. Wende (1979) 25 Cal.3d 436.
On December 16, 2008, we advised appellant that he had 30 days in which to submit a written brief or letter stating any contentions or arguments he wished us to consider. Appellant did not respond.
We have reviewed the record and are satisfied that no arguable issues exist. (People v. Kelly (2006) 40 Cal.4th 106, 123-124; People v. Wende, supra, 25 Cal.3d at p. 441.)
The judgment is affirmed.
