People v. Austin James Woodbury

LC No. 19-010252-FC

Michael J. Kelly Presiding Judge Amy Ronayne Krause Brock A. Swartzle Judges

ORDER

The motion to waive fees is GRANTED for this case only.

In lieu of granting the application, we VACATE the August 17, 2022 opinion and order of the Clinton Circuit Court denying defendant's motion for relief from judgment. We REMAND this case to the trial court for reconsideration of that order. The trial court's stated basis for denying the motion was that "[i]t plainly appears that defendant is not entitled to relief he seeks pursuant to MCR 6.504(B)(2)." This does not fulfill a trial court's responsibility "to provide a concise statement of the reasons for the denial," as required by MCR 6.504(B)(2). In order to facilitate appellate review, the trial court shall provide its reasoning in support of its ruling on defendant's motion for relief from judgment. People v Finnie, 504 Mich. 968; 933 N.W.2d 43 (2019).
