Defendant having moved for permission to file an incomplete CPL 460.15 application seeking permission to appeal the order of Cayuga County Court entered February 9, 2011, and for other relief,

Now, upon reading and filing the statement of Ricky Lee Winters dated August 23, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.

Memorandum: A procedurally compliant CPL 460.15 application should contain all papers submitted to the court whose order is sought to be reviewed (see 22 NYCRR 1000.13 [o]).
