THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. RICKY LEE WINTERS, DEFENDANT-APPELLANT.


PRESENT: , P.J., SMITH, CENTRA, PERADOTTO, AND CARNI, JJ.

Defendant having moved pursuant to CPL 460.30 to extend the time to move for leave to appeal from an order of the Cayuga County Court, dated November 20, 2013, and for other relief,

Now, upon reading and filing the statements of Ricky L. Winters dated March 14, 2014 and March 23, 2014, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to move for leave to appeal is granted on the condition defendant file and serve an application pursuant to CPL 460.15 on or before June 20, 2014, and

It is further ORDERED that the motion is otherwise denied.
