People of Michigan v. Charles Dupree Wingfield

LC No. 18-003735-FH

Michael F. Gadola Presiding Judge Stephen L. Borrello Michael J. Kelly Judges

ORDER

In lieu of granting leave to appeal, we vacate defendant's sentence and remand to the trial court for articulation of the trial court's reasons for its upward departure from the minimum sentencing guidelines range or for resentencing.

We do not retain jurisdiction.

Gadola, P.J. Because I believe the trial court adequately justified its 7-month upward departure from the sentencing guidelines in this case, I would deny the application for leave to appeal and deny the relief requested.
