Dennis Wilson, in pro. per.; and Donna L. Harris, under appointment by the Court of Appeal, for Defendant and Appellant. [Appointed.]. No appearance for Plaintiff and Respondent.


A jury convicted Dennis Wilson of assault with a deadly weapon (a knife) and vandalism (Pen. Code, §§ 245, subd. (a)(1); 594, subd. (a)). The jury found Wilson personally used a dangerous or deadly weapon in committing the assault and personally inflicted great bodily injury upon Marcelino Avila (Pen. Code, §§ 12022, subd. (b)(1); 12022.7, subd. (a)). The court imposed a total term of 10 years in state prison.

We appointed counsel to represent him on appeal.

After examination of the record, counsel filed an "Opening Brief" in which no issues were raised. On April 8, 2003, we denied Wilsons propria persona request for new appellate counsel. On April 17, 2003, we advised Wilson he had 30 days within which to personally submit any contentions or issues that he wished us to consider.

On May 22, 2003, Wilson personally filed a hand-printed response, in which he makes several contentions arising from the admission into evidence of the knife recovered by police. Wilson appears to claim the prosecutor committed misconduct by falsely arguing a connection between the knife and Wilson, the court prejudicially abused its discretion by admitting the knife into evidence, and there was insufficient evidence the knife recovered was the one used in the assault. The record fails to support his claims.

We have examined the entire record and are satisfied that Wilsons attorney has fully complied with the responsibilities of counsel and that no arguable issues exist. (Smith v. Robbins (2000) 528 U.S. 259, 277-284, 145 L. Ed. 2d 756, 120 S. Ct. 746; People v. Wende (1979) 25 Cal.3d 436, 441, 158 Cal. Rptr. 839, 600 P.2d 1071.)

The judgment is affirmed.
