In lieu of granting leave to appeal, the circuit court's order of November 19, 1997, denying the defendant's motion for relief from judgment, is vacated, and the case to the circuit court for reconsideration of the defendant's motion. MCR 7.302(F)(1). The trial judge's opinion denying the motion mistakenly identified as the issues raised those that the defendant had raised in his appeal of right. Thus, the court did not deal with the issues which were in fact presented in the motion for relief from judgment.Court of Appeals No. 208161.
