People v. Wilson

Appellate Term of the Supreme Court of New York, First Department
Feb 26, 2008
2008 N.Y. Slip Op. 50359 (N.Y. App. Term 2008)

Opinion

570390/03.

Decided February 26, 2008.

Defendant appeals from a judgment of the Criminal Division of Supreme Court, Bronx County (Michael R. Sonberg, J.), rendered May 14, 2002, after a jury trial, convicting her of assault in the third degree, criminal possession of a weapon in the fourth degree, criminal contempt in the second degree and harassment in the second degree, and imposing sentence.

Judgment of conviction (Michael R. Sonberg, J.), rendered May 14, 2002, affirmed.

PRESENT: McKEON, P.J., DAVIS, SCHOENFELD, JJ.

The verdict was not against the weight of the evidence. There is no basis for disturbing the jury's determinations concerning credibility, including its evaluation of the reliability of the complainant's testimony and the weight to be given to her background ( see People v Bleakley, 69 NY2d 490, 495).

THIS CONSTITUTES THE DECISION AND ORDER OF THE COURT.
