On order of the Court, the delayed application for leave to appeal from the August 17, 2000 decision of the Court of Appeals is considered and, pursuant to MCR 7.302(F)(1). The defendant's amendment was received by the trial court before it fully ruled on defendant's first motion for relief from judgment, so there was a pending motion to amend or supplement.

We do not retain jurisdiction.
