ORDER
By order of January 27, 2021, the prosecuting attorney was directed to answer the application for leave to appeal the July 16, 2020 order of the Court of Appeals. In response to the Court's order, the Attorney General filed a motion to remand for resentencing. On order of the Court, the application for leave to appeal and the motion to remand are considered. Pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Saginaw Circuit Court for resentencing in Docket No. 18-045410-FC. On remand, the trial court shall sentence the defendant consistent with the evaluation under People v Cobbs, 443 Mich. 276, 283 (1993), for a minimum sentence of 127 months, which was the top of the anticipated sentencing guidelines range, or allow the defendant to withdraw his plea under MCR 6.310(B)(2)(b).
We do not retain jurisdiction.
