[Modification of opinion (105 Cal.App.4th 1329; 130 Cal.Rptr.2d 234) on denial of petition for rehearing.]

This modification requires the movement of text affecting pages 1332-1334 of the bound volume report.

OPINION

MOORE, J.

IT IS ORDERED that the opinion filed herein on January 31, 2003, be modified as follows:

1. On page 2, in the fourth full paragraph, delete the third sentence [105 Cal.App.4th 1332, advance report, 3d full par., 3d sentence] and replace it with the following sentence:

The complaint also alleged defendant inflicted serious bodily injury, and had a 1995 conviction for felony assault, a prior serious felony within the meaning of the "Three Strikes" law and section 667.5, subdivision (a), a 1995 conviction for felony false imprisonment, and had served a prior prison term, pursuant to section 667.5, subdivision (b).

The petition for rehearing is DENIED. This modification does not effect a change in the judgment.
