ORDER MODIFYING OPINION

The opinion filed February 23, 2010, is modified to correct a typographical error as follows. On page 19, lines 8-9 of the typed opinion, delete the sentence “So he starts out – theoretically, I am saying that this is proven beyond a reasonable doubt, any reasonable doubt at all.” Replace that sentence with the following: “So he starts out – theoretically, I am saying that this is not proven beyond a reasonable doubt, any reasonable doubt at all.”
