Appellant having moved for poor person and assignment of counsel on the appeal taken from the judgment of Orleans County Court rendered January 3, 2011, and for other relief,

Now, upon reading and filing the affirmation of Timothy P. Murphy, Esq. dated January 27, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the filing and serving of an application seeking leave to appeal as a poor person from the appeal taken from the judgment of Orleans County Court rendered January 3, 2011, which contains an affidavit from appellant establishing his indigency (see 22 NYCRR 1000.14 [a] [1]).
