ORDERED that the decision and order on motion dated February 22, 2012 in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:

Appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered July 9, 2009.

On the court's own motion, it is

ORDERED that the appeal is stricken from the general calendar, as the record transmitted to this court is missing all the papers other than the transcript; and it is further,

ORDERED that the appeal shall be perfected by May 4, 2012; and it is further,

ORDERED that in the event the appeal is not perfected on or before May 4, 2012, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal on three days' notice, and may serve such application in person.
