Defendant having moved pursuant to CPL 460.10(6) to amend the notice of appeal filed in the Office of the Clerk of the County of Monroe on October 25, 2011,

Now, upon reading and filing the affirmation of Drew R. DuBrin, Esq. dated January 17, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and the notice of appeal filed on October 26, 2011 is hereby deemed to be a valid notice of appeal from the judgment rendered on September 30, 2011.
