Appeal from the Erie Trial Term.

Present — McCurn, P.J., Vaughan, Wheeler, Williams and Bastow, JJ.


Judgment of conviction affirmed. All concur, except Williams, J., who dissents and votes for reversal and for granting a new trial, because of errors in the charge of the court.
