People v. Williams

Appellate Division of the Supreme Court of New York, First Department
Oct 8, 2009
66 A.D.3d 440 (N.Y. App. Div. 2009)

Opinion

No. 1145.

October 8, 2009.

Judgment of resentence, Supreme Court, New York County, (Carol Berkman, J.), rendered November 19, 2008, resentencing defendant, as a second violent felony offender, to a term of seven years with five years' postrelease supervision, unanimously affirmed.

Robert S. Dean, Center for Appellate Litigation, New York (Mark W. Zeno of counsel), for appellant.

Robert M. Morgenthau, District Attorney, New York (Matthew C. Williams of counsel), for respondent.

Before: Mazzarelli, J.P., Friedman, Catterson, Renwick and Abdus-Salaam, JJ.

Defendant's challenges to his resentencing, which added a period of postrelease supervision, are similar to arguments rejected by this Court in People v Rodriguez ( 60 AD3d 452) and People v Hernandez ( 59 AD3d 180, lv granted 12 NY3d 817), and we decline to revisit those decisions or reach a different result.
