I would remand for an evidentiary hearing on the defendant's claim of ineffective assistance of counsel, so as to provide the defendant with an opportunity to subpoena the informant's telephone records to buttress defendant's claim that the informant communicated with the defendant without supervision from his police superiors, and made statements not reflected on the recordings.


I concur with LEVIN, J.
