OPINION

MORRISON, Acting P.J.

The court having been advised by the Attorney General that appellant Shayne Mason Willard died on April 19, 2007, during the pendency of this appeal, hereby vacates the judgment and remands the matter to the trial court with directions to enter an order permanently abating all proceedings with respect to this defendant. (People v. Dail (1943) 22 Cal.2d 642, 659; People v. Bandy (1963) 216 Cal.App.2d 458, 466.)
