Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of Supreme Court, Erie County rendered May 10, 2013, and for other relief,

Now, upon reading and filing the affidavits of Mel T. Wilkins sworn to June 27, 2014 and June 28, 2014, the notices of motion with proof of service thereof, the affirmation of David M. Abbatoy, Jr., Esq. dated July 16, 2014, and the statement of Donna A. Milling, Esq. dated July 29, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the motions are dismissed as unnecessary.
