Decided February 26, 2008.

Appeal from a judgment of the Criminal Court of the City of New York, Kings County (William L. McGuire, Jr., J.), rendered December 2, 2005. The judgment convicted defendant, upon a jury verdict, of endangering the welfare of a child.

Appeal dismissed without prejudice to a motion to reinstate the appeal should defendant return to this court's jurisdiction.

PRESENT: PESCE, P.J., WESTON PATTERSON and GOLIA, JJ.


Defendant was found guilty of endangering the welfare of a child (Penal Law § 260.10) and sentenced to a one-year term of incarceration. Defendant was deported from the United States on June 5, 2006. Accordingly, we dismiss the appeal without prejudice. Should defendant return to this court's jurisdiction, he can seek to have this appeal reinstated ( see People v Hernandez, 8 NY3d 906; People v Diaz, 7 NY3d 831).
