People of Michigan v. William Whateley

LC No. 17-002406-01-FH

Anica Letica Noah P. Hood Judges

ORDER

MICHAEL J. RIORDAN PRESIDING JUDGE

The motion to waive fees is GRANTED for this case only.

The motion to remand is DENIED.

The delayed application for leave to appeal is DENIED because defendant has failed to establish that the trial court erred in denying the motion for relief from judgment. Although the trial court erred by conflating the "outcome determinative" prejudice standard for plain error with the "reasonable probability" prejudice standard that applies to claims of ineffective assistance of counsel, see generally People v Randolph, 502 Mich. 1, 14-15; 917 N.W.2d 249 (2018), such error was harmless here because the trial court nevertheless reached the correct ultimate outcome, see People v Moorman, 331 Mich.App. 481, 490; 952 N.W.2d 597 (2020) ("This Court will not reverse when the trial court reaches the right result for the wrong reason.").
