Appeal by defendant from a judgment of the Court of Special Sessions of the City of New York, Borough of Queens, rendered November 4, 1960, convicting him, after trial, of indecent exposure (Penal Law, § 1140), and sentencing him to serve 30 days in the Workhouse, the execution of the sentence being suspended during his good behavior. Judgment reversed on the law and the facts and a new trial ordered. In our opinion, defendant's guilt was not established beyond a reasonable doubt. Nolan, P.J., Ughetta, Kleinfeld, Pette and Brennan, JJ., concur.
