ORDER MODIFYING OPINION AND DENYING REHEARING NO CHANGE IN JUDGMENT

THE COURT:

It is ordered that the opinion filed herein on April 27, 2012, be modified as follows:

1. On page 8, the first full paragraph, the last sentence beginning with "Moreover, the record" and ending with "misdemeanor trial" is deleted.
2. On page 9, the first full paragraph, the second sentence beginning with "When the prosecutor" and ending with "and prison term" is deleted.

There is no change in the judgment.

Appellant's petition for rehearing is denied.
