On order of the Court, the delayed application for leave to appeal from the December 7, 2001 decision of the Court of Appeals is considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration of the issue whether the error identified in the second paragraph of the Court of Appeals opinion was harmless beyond a reasonable doubt. People v Anderson (After Remand), 446 Mich. 392; 521 N.W.2d 538 (1994).
