People of Michigan v. Maxxim Balthazar Wells

Docket No. 364301 LC No. 20-004354-FC

Noah P. Hood Presiding Judge Michael J. Riordan Kristina Robinson Garrett Judges

ORDER

The application for leave to appeal is DENIED.

Garrett, J., would grant the application for leave to appeal to determine whether the trial court erred by failing to consider defendant's youth as a mitigating factor when imposing its sentence. See People v Boykin,___ Mich. ___, ___; ___ N.W.2d ___(2022) (Docket No. 157738); slip op at 12-13 (explaining that "youth is a mitigating factor" and a "relevant offender characteristic [that] must be considered at sentencing").
