People v. Watson

Appellate Division of the Supreme Court of New York, First Department
Feb 21, 2002
291 A.D.2d 308 (N.Y. App. Div. 2002)

Opinion

178

February 21, 2002.

Judgment, Supreme Court, Bronx County (Joseph Fisch, J.), rendered February 7, 2000, convicting defendant, upon his plea of guilty, of manslaughter in the first degree, and sentencing him to a term of 12½ to 25 years, unanimously affirmed.

RAFFAELINA GIANFRANCESCO, for respondent.

WALTER EVANS, JR., for defendant-appellant.

Before: Tom, J.P., Mazzarelli, Sullivan, Wallach, Marlow, JJ.

Defendant knowingly and intelligently waived his right to appeal (see, People v. Moissett, 76 N.Y.2d 909), and this waiver forecloses review of his excessive sentence claim (People v. Seaberg, 74 N.Y.2d 1, 9). In any event, we perceive no basis for a reduction of sentence.

THIS CONSTITUTES THE DECISION AND ORDER OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
