People v. Watson

Appellate Division of the Supreme Court of New York, Second Department
Sep 20, 2011
87 A.D.3d 1086 (N.Y. App. Div. 2011)

Opinion

No. 2009-10689.

September 20, 2011.

Appeal by the defendant from a judgment of the Supreme Court, Queens County (Knopf, J.), rendered November 5, 2009, convicting him of criminal possession of a weapon in the second degree, upon his plea of guilty, and imposing sentence. Assigned counsel has submitted a brief in accordance with Anders v California ( 386 US 738), in which he moves for leave to withdraw as counsel for the appellant.

Lynn W. L. Fahey, New York, N.Y. (Paul Skip Laisure of counsel), for appellant.

Richard A. Brown, District Attorney, Kew Gardens, N.Y. (John M. Castellano and Merri Turk Lasky of counsel; Andrew Dykens on the brief), for respondent.

Before: Dillon, J.P., Dickerson, Leventhal, Austin and Miller, JJ.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v California, 386 US 738; People v Paige, 54 AD2d 631; cf. People v Gonzalez, 47 NY2d 606).
