People of Michigan v. Jeffery Deshaun Watkins

LC No. 19-014890-FH

Anica Letica Presiding Judge Deborah A. Servitto Noah P. Hood Judges

ORDER

This Court's October 13, 2022 opinion and order vacated defendant's judgment of sentence and remanded to the trial court to "hold an evidentiary hearing to determine if defendant was made aware of the SORA implications of his plea in a manner that satisfied due process." On remand, on November 18, 2022, the trial court held an evidentiary hearing, but it failed to determine whether defendant was made aware of the SORA implications of his plea in a manner that satisfied due process. Therefore, on January 19, 2023, this Court again remanded this case to the trial court to place its findings and determination in writing and to issue an appropriate order or judgment. That same day, the trial court entered an opinion and order holding that defendant was not sufficiently made aware of the SORA implications of his plea in a manner that satisfied due process. In light of our October 13, 2022 opinion, and the trial court's findings on remand, we remand to the trial court with instructions to hold a hearing to advise defendant of the error and allow defendant to withdraw his plea, or let the plea and sentence stand. This appeal is now CONCLUDED. We do not retain jurisdiction.
