People of Michigan v. Thomas Louis Washington

LC No. 09-031281-01-FC

ORDER

Elizabeth L. Gleicher, Chief Judge, acting under MCR 7.203(F)(1), orders:

The motion to waive fees is GRANTED for this case only.

The delayed application for leave to appeal from the December 6, 2021 order is DISMISSED for lack of jurisdiction because appellant failed to file the application within the time period required by MCR 7.205(A)(4)(a). The six-month period to file the application cannot be counted from entry of the May 2, 2022 order denying the motion for reconsideration because the motion for reconsideration was not filed within 21 days after entry of the December 6, 2021 order. MCR 7.205(A)(1)(b). Regardless, the application was not filed within six months of entry of the May 2, 2022 order.
