DECISION & ORDER ON MOTION

Motion by the appellant to extend the time to comply with a decision and order on motion of this Court dated March 6, 2013, on an appeal from a judgment of the Supreme Court, Kings County, rendered December 8, 2010.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, and on or before August 6, 2013, the appellant's retained counsel, Amelio P. Marino, Esq., is directed to either perfect the appeal or move for leave to withdraw as counsel if the appellant is not willing to consent to the filing of the brief prepared by retained counsel.
