By order of October 25, 2004, the application for leave to appeal was held in abeyance pending the decision in People v. Stewart (Docket No. 124055), Pursuant to MCR 7.302(G)(1), in lieu of granting leave to appeal, we vacate the March 11, 2004 order of the Court of Appeals and the August 21, 2003 opinion and order of the Washtenaw Circuit Court and remand this case to the Washtenaw Circuit Court for reconsideration in light of our decision in People v. Stewart, 472 Mich 624 (2005). We do not retain jurisdiction.
