People v. Walters

Appellate Division of the Supreme Court of New York, Second Department
Nov 24, 1997
244 A.D.2d 587 (N.Y. App. Div. 1997)

Opinion

November 24, 1997

Appeal from the Supreme Court, Queens County (Appelman, J.).

Ordered that the judgment is affirmed.

The Supreme Court properly seated a white male venireperson who was peremptorily challenged by the defense. The Supreme Court's determination that the defense's explanation for the challenge constituted mere pretext is supported by the record ( see, e.g., People v. Readous, 232 A.D.2d 583).

The defendant's remaining contentions are without merit.

Santucci, J. P., Joy, Friedmann and Luciano, JJ., concur.
